hi guys
just a quick update on my fight with the dwp.
i am still awaiting a date for my dla appeal and september seems a long way off right now. after having a second medical with the "lovely" people from atos i have now been decliared fit for work. apparently my legs are all better but my hands have got worse!!!! i can now dispite having problems for years walk for as lpng as i want due to the ankle spint i have apparentlt it stop all the pain i am in and cures exhaustion amazing!!!!
ok i am being sarcastic but i am so fed up of fighting not only the dwp but the NHS as well, as my physio has refused to even call my solictor back let alone send me copies of my reports, on the plus side i've found out that if i write to my local pct they have to send me copies of my medical records which means i can get hold of my physio reports even if i have to pay of them which will hopefully prove everything i need to for both the dla and esa apppeal
right now tho i feel like finding a nice quiet corner to spend some time rocking and crying in!!!

18 years of random falls, subluxes, and having many bendy party tricks was finally dignosed as having BJHS, still fighting for some help from GP, but after all this time I realise that I'm neither weird or alone :-)

DLA appeal turned down.

I had a letter today to say my DLA appeal was turned down! Not sure where to go from here, thinking of just giving up because it's too stressful, they say I could make a meal myself and that even though my walking is poor I can still walk a little, they also said because I don't need 20 minutes of care at night that I am not entitled to any care rate.

They have again basically contradicted what I've said. :S :( I have given up hope.

Sorry to hear your news, you can of course re apply making sure you have more evidence to back you up, do you have any recent stuff that might not have been included in your appeal? I was turned down on my first application but didnt appeal ( i made a hash of the application) so I re applied to include upto date evidence etc.
Remember most applications are turned down at the first try so not all is lost.

well i finally got my date for my appeal 17/07
just hoping everything goes my way not sure i can cope my main concern is that i've had my esa taken off me cos of yet more atos lies so i am appealing that its all getting on top of me and can't seem to get any support from the nhs both for this and the pain i am in grrrrrrrrrrrrrrrrrrrrr

Got a letter through stating they still can't make a decision for DD's case as they haven't heard from her GP. They have written to them twice.

Appeal for ESA on the 5/7

Hopefully that's a good sign that they haven't dismissed her case right away.

I had mine done on the 6th of july, i went to get my medical examination done and my mother with me, by the time i got there i was told that were running 45 mins and some of the doctors were not gonna turn up there were already loads of people there and they were trying to cancel as many people's appointments as possible. My medical examination was a totally joke i got questions like do i watch tv, what sports do i watch etc etc. I knew it was gonna get from bad to worse as answers i was given to questions the doctor was given his own answers so for example he asked how long it took for me to get there i said over hour and he said 45 mins then. He asked me if i can walk 200 yards to shops to which i said yes but i have to walk slowly and take my time as the problem i have is with my knees, i told him that the shops were right next to where i live but i pretty never go and for the most part i only go to my GP who's medical centre is on the same road as i live or if i have to go to the chemist to pick up my medication again i have take my time and i walk with a bad limp. I was asked if i cook for myself, who does the washing whether its plates or clothes i said my mother does as am always in pain for the most to which he so your mother does all this and the general house to which i said yes. i got asked if use a microwave and or make tea i said yes but obvious i stand wait for the kettle to boil or the microwave to re heat food, to which my mother told him she's aways bringing my meals. He asked me how often i had a bath i said it various depending on now much pain am in as what i do is i set the bath with sea salts and i fill the bath with lots of hot water and lay in there as hot as i can bare the water and lay in there for quite a while which actually keeps with the pain but doesn't totally get rid of it so he said a hour then. i also got asked what time i get up again i told him it various as because am in so pain i hardly sleep and even been to the doctor to try and get sleeping tablets but wasn't allowed them as am taking pain killers, i also said i suffer from bad migraines which i have since a child i have to say in a really a dark room when i get them and any ounce of light and it makes it worse and i end up throwing up food and even acid and effects last for hours if not days.
I got asked loads more questions some nothing to do with my condition and while sitting in a char all i was asked to was turn my head left and right, stretch my arms left and right and to bend my hands and try touch the fall while sitting down.
I was then asked to read off a to test my eyes to which he choose the two biggest letters to read which even tho i could see them am actually very short sighted. I was told to then lay down on the bed and try and lift up my legs to which i couldn't as my knees were in pain and badly swollen up in fact both knees were at least twice the normal size, i couldn't move or lift them up and it was so painful i was actually crying in pain and he help me move my legs back into position. The last thing he did for me was the most shocking i was wearing jogging bottoms and he asked for me roll up my right leg to which me mother tried rolling up my jogging bottoms and couldn't because my knee was so swollen and i was wearing a bandage so my mother then helped me to try pull my jogging bottoms down so he could have a look at my knees and then just changed his mined, my mum said look we've travelled all the way down here and your not even gonna examine my sons knees and he just ignored her. My mother was a former nurse and also fully trained in the health care field. After that he said he would write his report and they would decide on what happens and according to him he has no input as to what happens and he doesn't like the way the system is and if i don't like the results then i could appeal to which after that he said take time getting home.
I got a letter from them turning me down and the doctor pretty much wrote a damning report he gave me zero on everything and even on questions i wasn't asked and questions were totally left and even after having the problems with not being able to lift or move my legs he just i have a lil discomfort. he even said my eye sight was fine but yet i had a eye test a few months before that i got given newer glasses with stronger lenses then my old ones, things like being dizzy he gave me zero even tho that happens if i have i either have migraines or if i take my medication and he never bothered to examine my knees and he had very poor english. The condition with knees are stuck with mr for life, there always swollen and am always in pain as i've been getting older they have been getting worse and i have lots of treatment to which none of it helped, my GP over the years has been unhelpful, i've seen loads of different specialist same answer and even paid for private treatment and doctors out of my own pocket and no help. Even when my mother said its genetic which it does say that in my medical file and that someone only dads side of the family has it the doctor said whats that got to do with it. Am currently appealing but i don't think i'll have a chance to win as years ago the same thing happened and i was told at the hearing that i couldn't complain during the appeal about the doctor doing a bad job with me being examined to which i lost that case, i re applied for income support and applied for DLA, for the DLA they sent someone to examine me at my home and the doctor actually checked my knees and found loads of things wrong and a couple years after that i was sent for another medical examination and luckily the doctor was a specialist in joints shed looked at it found all the problems and in fact found other things that were wrong. Am on income support and DLA to which am i get the middle rate for care and for mobility i get the higher rate and i was given a infinite award. I have rang my MP and they have passed it on to the CAB and they also told me to send in a detailed email about it. I fear i have no chance of winning my appeal as i think it will be set against me its dumb that the doctor never actually bothered to examine me, he wasn't putting down what i was actually saying and the medical examination is so poor.

have to have another medical ,AS the last one was illegible and rubbish (even had that in writing from atos ) so still waiting , its been a year now , but I am worse than when the last assessment was done at christmas :wall: :wall:

Well, DLA have still not heard from my daughter's GP. So they are sending a doc out to examine her on Saturday. Thought that was a strange day to do it, but hey ho, wish us luck.

Good luck for today , mine is tuesday ive refused to go to the centre as its four bus changes and I cant walk or drive , and i wanted my husband to be here and take notes.

Good luck - make sure you get a copy of the report as the decision I was given had no relation to the doctors report - challenged them on it and award magically went up!!!
Finally diagnosed March 2011 after 20 years of hypochondria!!!

Thnx SS. Only time will tell I guess. Can never tell how these things go, remember years ago thinking my father's medical went extremely well, only for his DLA to be stopped completely. They had him mixed up with someone else and the report was not about my father, but it took months of stress before it got sorted out. Will update as soon as we hear anything as we're still waiting for the tribunal for ESA to go ahead, it was adjourned for more medical evidence.

I had another DLA assessment last night because the last one was so badly written and untruthful , the doctor was pleasant and seemed to think i was having the medical for a continuation of DLA when I told him i had been waiting a year more or less for a decision he seemed genuinely shocked , he knew what EDS was and got very excited about my hypermobile knees ( the previous report found nothing ) he was also aghast at my floppy foot that is blue and cold even post operatively ! he seemed to care and be genuine , but i wont be fooled that easily... so lets wait and see :lol:
