Oh hun, I know how hard it is to go through this horrible process, but remember you are not alone - we are all here to help you and give you any advice we can. I did my claim and subsequent appeal on my own, as my local CAB are worse than rubbish and the local disability advice charity didn't want to know! I used the B&W guides and the advice of everyone on here, and I got my award. It is worth fighting for if you are entitled - don't let them bully you into giving up. If you can't face the tribunal, then make a new application and go through it all from the start. Hopefully you will get a more understanding decision maker next time. Cannot believe they refused you as you drive! Madness!

After the confusing conversation with the DM ive decided not to upset the apple cart something im normally
really bad at doing. Good luck to anyone appealing their DLA.

Hi all, I don't have DLA yet but I was directed to this topic by a very kind member. I got refused DLA so I am appealing, was just wondering what % of people get DLA on their appeal? just wondering what my chances will be.

I had an advisor with me for my appeal the first go around, but she really had no clue about pain or fatigue issues and was as stuck as the DWP on distance of walking issues, so I ended up only getting lower rate care.

When I asked for my award to be looked at again a few months later and did everything myself with the benefits and work guide as a help I ended up getting higher rate care and mobility (initial refusal then approval on reconsideration).

So really a lot of 'advisors' can be pants really.
Finally diagnosed with EDS-H and POTS after 20 years by the lovely Prof G \o/

Hi green lantern, it seems that things can be changed at appeal and some even get a call before the hearing from the dwp with a reconsideration. I am not sure what the stats are for getting dla on appeal but B&W may have something. I think the trick is to be prepared and continue collecting evidence and reports to be submitted to the pannel and if possible have someone with you for the tribunal, welfare rights person or similar, obviously thats not always an option but preparing is something you can do, and again B&W have sections on what to expect and how to deal with this situation.

trekster, as far as i understand the process, everyone will be re-assessed when they move to PIP, even if they have indefinite DLA awards, as it's a new benefit with a new structure and different criteria for the various awards.

Yes everyone will be reassessed but they are going to be bringing it in in phases like ESA so people whose claims were going to be ending near the time of the PIP transfer will be assessed first with the indefinites being last. This would give someone who was on indefinite a few years before they actually get transferred :shifty: Or at least that's how I think it's going to go anyway.

Yes sheppey you are right, it will be a phased introduction starting with a small sample group to see how that goes, the indefinates will be the last group to be assessed but everyone who will be moving to pip will have an assessment and "medical". there is more info on the pip thread and as we hear more we can put it on there.

The point I was making is that I am going to be reassessed 2 years earlier because the indefinite people will be assessed in 2016. My award lasts until 2014.

i know that they're doing it in stages trekster, i just wanted to make sure that noone was going to get a nasty surprise when they get called for re-assessment eventually

Hi trekster, just wondering, if you have an indefinate award and your re assessment is due in 2014 do you think they will put it back until they move those on indefinate awards. I know that even on indefinate awards we can be re assessed at any point during th award but as you have an indefinate award it would be sensible to leave you til they do the rest.

I'm not an indefinite award anymore I'm now a 2014 award, indefinites are assessed 2016 so I've lost 2 years by my award changing from indefinite to 2014. The DWP wont help when I try and ask for an explanation of my award they just get some random person to ring up instead of my DM (who hardly quoted stuff off the letter). My indefinite award now has an end date, I was so worried I asked the garage about the car being taken away and they mentioned it would be up to their discretion but I can't remember what they go on the DWP or me or a combination of the 2. The situation im thinking of is the delay in assessing my HRM when it runs out and me being in limbo regarding the car.

Oh trekster that is a reall worry especially as they changed your award length and I gather from your post they gave no reason for the change. hopefully when you are reassessed things will go in your favour, or there will be a elay in re assessments with the change over, I know that some people expecting to move from IB to ESA at a certain point ended up waiting longer for their transfer, I think it will be best not to worry too much until you know for sure what is going to happen, I am wondering that as you are on HRM that you will fill the descriptors for enhaced PIP then the car will carry on.

They refused to give me the real reason for indefinite just that 'indefinite doesn't mean for life', and they're the same company
that do the ESA changeovers.
